1. Acceptance of Terms

By accessing and using the Brocor Auctions platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Registration & Eligibility

• You must be at least 18 years of age to register and participate in auctions.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• FICA documentation may be required for verification purposes.

3. Auction Participation

• All bids placed are legally binding and cannot be retracted once submitted.
• The highest bidder at the close of an auction is obligated to complete the purchase.
• Buyer's premium and VAT may apply to all purchases as specified in each auction.
• Reserve prices may apply; items may not sell if the reserve is not met.

4. Payment Terms

• Full payment is due within 3 business days of auction close unless otherwise specified.
• Accepted payment methods include EFT, credit card, and bank transfer.
• Failure to complete payment may result in account suspension and legal action.
• All prices are displayed in South African Rand (ZAR).

5. Collection & Delivery

• Items must be collected within the timeframe specified in the auction listing.
• Delivery arrangements, if available, are at the buyer's expense unless stated otherwise.
• Risk passes to the buyer upon collection or delivery acceptance.

6. Voetstoots Clause

All items are sold "voetstoots" (as is, where is). While we endeavor to provide accurate descriptions, buyers are encouraged to inspect items before bidding. Brocor Auctions makes no warranties regarding the condition, fitness for purpose, or accuracy of item descriptions.

7. Limitation of Liability

Brocor Auctions acts as an intermediary between buyers and sellers. We are not liable for:

• Any defects in items sold
• Disputes between buyers and sellers
• Technical issues during live auctions
• Loss or damage during collection or delivery

8. Privacy & Data Protection

We are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA). Your data will only be used for auction-related purposes and will not be shared with third parties without consent.
